Steve Jackson Games (USDC, Austin) Represented
Steve Jackson Games in suit against the United States Secret Service.
This lawsuit defined the boundaries of legal protection for electronic
publishers and electronic mail, and set the limits on government
law enforcement officials searching for evidence of illegal computer
hacking.
Motorola v. Hitachi (USDC, Austin) Served as
local counsel for Hitachi with trial responsibility for damages
issues. Dispute concerned whether Hitachi infringed Motorola patents
in its H-16 and H-32 microcontrollers and whether, even if they
did, Hitachi was licensed to use that technology. Hitachi also had
a patent infringement claim that Motorola's 68000-series microprocessor
infringed Hitachi patents.
Sterling Drug v. Intermedics (USDC, Austin) Served
with patent counsel representing Intermedics and related companies
(Intermedics Orthopedics, CarboMedics and Calcitek, Inc.) in first
patent infringement suit tried before Austin federal Judge James
Nowlin.
CarboMedics, Inc. v. Wessex Medical, Ltd. (USDC,
Austin) Dispute over termination of English distributor for heart
valves, which involved, in part, the use or misuse of confidential
information.
Intermedics Orthopedics v. Encore Orthopedics
(State Court, Austin) Represented orthopedics company against former
president and key employees on covenant not to compete.

had contracted with a software supplier to purchase software and
was using the software to develop new software in cooperation with
Unisys. Software supplier then sued, claiming that Unisys and purchaser
had used confidential information in the form of techniques that
were not conveyed with the software.
Communication Specialists, Inc. v. Mast (State
Court, Austin) Reviewed issue of whether former employee's new software,
which performed functions similar to former employer's software,
infringed the copyright on the employer's software.
Aaron Rents, Inc./r:tracs v. (USDC, Austin) Represented
national rental company in dispute with computer hardware and software
supplier over suitability of computer hardware and software.
VDO v. Southland (State Court, Austin) Represented
Southland Corp. in dispute with videotape marketer VDO over performance
of contract where primary issue concerned the availability and adequacy
of computerized operation of the video rental transaction.
Tisoft, Inc. v. The Rocky Mountain Bank Note Company
(USDC, Austin) Dispute involving software development and modification
for the printing of bank checks.
Purcell Development Corporation, et al. v. Tomen America,
Inc. (State Court, Austin) A multimillion dollar breach
of partnership agreement, real estate development and usury case
in which a very substantial recovery was had for the client.
Pride Refining Corporation A series of cases
involving claims for control of the company and management of the
board of directors.
Caterpillar, Inc. A multimillion dollar dispute
between Caterpillar and The State of Texas over franchise taxes.

on the Barton Creek properties.
