K&O Limited Partnership v. CTTI, et al. Jury verdict and judgment of $1.1 million in commercial construction
case. Also obtained substantial additional settlements.

Armstrong et al v. Main Street Homes. Significant
arbitration award for a group of over 30 homeowners.

In re Steiner. Represented successful will
proponent of the T.C. “Buck” Steiner estate.

Mullen v. Principal. Jury verdict of over
$10 million for defamation claim.

Confidential settlement of aviation wrongful death case on behalf of pilot’s estate against aircraft operator
and manufacturer.

Confidential settlement of several psychiatrist misconduct
cases.

Several multi party arbitrations for national
homebuilder.

Mitchell v. Texas Department of Housing and Community
Affairs. Injunction against agency action denying application
for low income housing credits.
REPRESENTATIVE LITIGATION CASES

Fiduciary and Business Litigation. Troup v.
Rigaku -- Substantial settlement for company founder
against venture capital firm that took control of company. Scipioni
v. Empire Funding – confidential settlement for company
president against company founder for breach of duty.

Intellectual Property Litigation. Defense of architectural
copyright case against homebuilder. Defense of trade
dress case against chain of home furnishing stores. Defense
of alleged theft of trade secrets case against beauty products
manufacturer.

Personal Injury and Tort Litigation. Woodward
v. Union Pacific -- 3.5 million dollar recovery against
Union Pacific in grade crossing case. Numerous other personal
injury and wrongful death verdicts and settlements.

Civil Rights, Constitutional, and Public Sector Litigation. Operating Contractors v. State of Texas. $23
million judgment for contractors involved in terminated state
air pollution control program, settled on appeal. Savely
v. Houston. Jury verdict, later reversed on appeal,
declaring that annexation of Clear Lake City by Houston was
invalid.

Real Estate Litigation. Favorable resolution for a
title company of major exposure resulting from adverse
title claims to a large gated community. Defense of
several multi-million Deceptive Trade Practices Act claims.

Class Action Litigation. Obtained class certification of class of employees alleging age discrimination. Represented
class of doctors alleging underpayments by HMO.

Insurance and Coverage Litigation. Ryland Group,
Inc. v. Travellers Indemnity -- Obtained declaratory
judgment that costs of defense were covered in copyright infringement
case. Brady National Bank v. Gulf Insurance Co. -- Obtained declaratory judgment that Banker’s Bond covered
losses associated with Ponzi scheme.

Employment Litigation. Tried or settled in
excess of 20 cases for employees who reported or refused
to engage in illegal conduct in the workplace and were fired
as a result, including a $13.5 million verdict for a state whistleblower,
a $1.1 million recovery for a police officer who arrested a
superior officer for driving while intoxicated, and substantial
sums for employees reporting, among other things, accounting
irregularities, kickbacks, environmental misdeeds, and violations
of NCAA Division I football rules.
